Legionella Risk Assessment for a commercial property.
Many Residential and Commercial Landlords including Letting Agents, Managing Agents and Duty-Holders are not aware of their legal responsibilities under the Health & Safety at Work Act 1974 and The Management of Health & Safety at Work Regulations (MHSW) 1999, to protect their tenants and visitors from Legionnaires Disease.
Since the L8 Approved Code of Practice (3rd edition) (ACOP) was published in 2001, there has been a legal requirement for landlords and/or Duty Holders (e.g. Letting Agents) of both domestic, residential and commercial premises to assess the risks of exposure to Legionella to their tenants and visitors. If a tenant or a visitor to your property were to contract Legionnaires Disease, the landlord or Duty Holder (or both) may be liable to prosecution under HASWA and they would have to demonstrate to a court that they have fulfilled their legal duty, so it is important that you assess, record and control the Legionella risks.
For Domestic and Commercial properties, it is recommended that a Legionella Risk Assessment is carried out every two years or at the change of a tenancy, whichever is the soonest.
