The Commercial Minimum Energy Efficiency Standards for a non-domestic property or Commercial MEES legislation came into effect on 1st April 2018 in England and Wales, and it applies to all commercial rented or leased properties.
The legislation now makes it illegal to rent or lease a commercial property if the energy efficiency rating is an ‘F’ or a ‘G’, this is based upon the results of the Commercial Energy Performance Certificate (EPC).

The Minimum Energy Efficiency Standards were introduced to encourage Commercial Landlords to improve the energy efficiency of their older building stock, which will help to achieve the Global Carbon Reduction targets for 2020 and 2050, whilst also reducing the heating/running costs for their tenants.
If your non-domestic or commercial property has an Commercial EPC Energy Efficiency Rating of a ‘F’ or ‘G’, then it is illegal to rent or lease the property to a tenant.
The new legislation has had a great impact on UK commercial property market for properties which are rated ‘F’ or ‘G’, apart from it now being illegal, most commercial mortgage lenders and pension schemes administrators will no longer provide a mortgage, or allow a commercial property to be included into a pension fund unless it achieves the Minimum Energy Efficiency Standards of an ‘E’ rating.
It is common that some of the energy efficiency measures that are recommended by the Commercial Energy Performance Certificate (EPC) are inappropriate or very disruptive for a particular property. Additionally, more than one commercial energy efficiency measure may be required to be installed to improve the property. We therefore re-model the property by inputting various energy efficiency measures into our accredited software to identify the most appropriate, lowest cost and least disruptive energy efficiency measures available, whilst still achieving the desired energy rating.
During this process we liaise with you upon the suitability and viability of the various energy efficiency measures available – examples of the measures include, installing wall, loft or floor insulation, installing an energy efficient commercial boiler or heating system or simply installing an energy efficient lighting system.
Once the recommendations have been agreed and installed, our accredited commercial energy assessor can then re-visit the property to ‘sign-off’ the energy efficiency improvements installed and reproduce a new Commercial Energy Performance Certificate or Non-domestic EPC that reflects the improvements made.
The Minimum Energy Efficiency Standards or MEES for Commercial or Non-Domestic Properties are enforced by the Local Weights and Measures Authorities. They have the power to impose financial penalties for non-compliance, linked to the rateable value of the property, and could be as much as £150,000.00.
Apart from the above legal and financial implications, by making energy efficiency improvements to your commercial property you will also be improving the buildings' Energy Efficiency which helps reduce energy bills and may increase both the salable and rental value of the property.
Firstly, we would instruct one of our qualified, accredited Commercial Energy Assessors to visit your property to carry-out an initial energy efficiency assessment of the property, we will then produce a Commercial Energy Performance Certificate (EPC).
If the energy rating of the EPC is an F or G (a fail), we can then further discuss the options available and provide you with the appropriate Commercial MEES advice and offer guidance to ensure your property achieves the Commercial Minimum Energy Efficiency Standards.
